The publication of Vasily Kandinsky’s Improvisation No. 30 (Cannons), in the United States in 1919 (shown in Case 2) establishes that the work is in the public domain in the United States. However, the same result does not necessarily follow from the publication of the same painting in this earlier German catalogue, which does not include a copyright notice. Paradoxically, if this catalogue had been published in the United States without a complete copyright notice, the work would have immediately fallen into the public domain for failure to include such copyright notice.
